The amount payable is calculated by applying the percentage shown in the table to the total annual rate of remuneration (including the value of any additional benefits that form part of gross taxable pay). There is a minimum introduction fee of £1000 plus VAT. All fees are subject to VAT at the appropriate rate.
REBATES
If a candidate leaves your employment within 8 weeks of commencement for any reason other than redundancy, we offer the following rebate provided that
You inform us of the termination of employment in writing within 7 days.
You have paid the introduction fee.
If you re-engage the candidate within 12 months the rebate is forfeit and repayable. If you accept a replacement you cannot also have a rebate.
DETAILED TERMS
InTouch (Leodis) Ltd (trading as InTouch) is an employment agency as defined in the Conduct of Employment Agencies and Employment Business Regulations 2003.
You are deemed to have accepted these business terms if you ask InTouch to introduce a candidate for any position, or you engage or make use in any role of a candidate introduced by us.
By asking us to act on your behalf, you are authorising us to do so, including the advertising of positions for which you seek to fill.
These terms can only be varied if we confirm this to you in writing.
You will notify us immediately if you offer a post to a candidate, or if you engage or make use of a candidate in any role.
If you make use of or agree to employ a candidate, you are liable for the Permanent Staff Introduction Fee shown in our current Business Terms.
You will pay our invoice for fees and other charges within 16 days of the date of posting. All invoices are dispatched by First Class mail. Cheques should be payable to InTouch (Leodis) Ltd at our address below.
We reserve the right to charge interest at the rate of 3% per month from the invoice date for overdue invoices.
You must provide us with the following information about the position that you are seeking to fill:
a.
The full name, registration number and address of your company
b.
Details of the position, including title of post, nature of work, hours, location, start date and (where appropriate) duration.
c.
Your expectations of suitable candidates, including training, experience, qualifications and any legal requirements that are inherent, such as membership of professional bodies etc.are inherent, such as membership of professional bodies etc.
d.
Remuneration offered, including other benefits, and detail of the intended contractual relationship if not by way of employment.
e.
Notice stipulated on termination of employment by either side.
f.
Details of any risks to health or safety of which you are aware.
g.
Any information that implies or suggests a potential detriment to the interests of the candidate.
You are responsible for satisfying yourself that the candidate is suitable for the position. Where necessary, you must obtain a work permit.
We naturally accept responsibility arising out of our negligence. We cannot accept responsibility in other circumstances.
If you withdraw an offer of employment after a candidate has accepted it, you will be liable for a cancellation fee of 50% of the Permanent Staff Introduction Fee.
If you (or your agent) engage a candidate in any capacity who was introduced to you by us within the previous year, or you are instrumental in facilitating such an appointment by a third party, you will be liable for a Permanent Staff Introduction Fee based on the appointee’s rate of annual remuneration, or a fee of £4000, whichever is the lower. Interest will be charged at 3% from the date of the appointment.
We will supply on request copies of any relevant documents about the candidate which we have authorisation to disclose which may provide evidence of qualification or suitability (where relevant) to work with vulnerable people.
These terms are governed by the law of England and are subject to the exclusive jurisdiction of the Courts of England.
